Co-signing: What You Need to Know Part One

Cosigning: What You Need to Know Part OneIf you’ve never been arrested or have dealt with posting bail the whole process can seem overwhelming.  Between all the details and lingo it can be hard to know where to start.  Especially if someone you love and care about has been arrested and now they’re asking for you to cosign for their bail bond.  What does that mean and what risks are involved?  In today’s post we’re going to look at what it means to cosign for someone’s bail bond in Delaware.  What your responsibilities are as a cosigner and what risks are involved.

Co-signing: What You Need to Know

  • The Risks

When you’re considering co-signing for a friend or loved one it’s important to know the facts.  Firstly, you will be signing a legally binding document.  Which means you cannot back out or refuse to be responsible if the defendant violates their terms of release or misses their court date.  Secondly, if the defendant does violate their terms of release, is rearrested or if they miss their court date you will be held responsible.  This means you will be financially responsible and will be required to pay any and all fees, fines and penalties.  If you chose to use collateral in order to pay for bail it will be seized.  It’s important to keep all of this in mind when deciding whether or not you should cosign for someone.
